Abstract: The present work has for objective to present the evolutionary road of the Commercial Right, starting from the suffered changes for the own nature of the mercantile activity, due to the evolution of the social relationships. At the beginning, the understanding of the origin of the Commercial Right is looked for, that goes by the trade notion and for the characterization of that activity type through the times. After the general approach, it is treated of the development of the Commercial Right in Brazil: from the time of the colonization, going by the Commercial Code of 1850 and the theory of the trade acts to the coming of the Civil Code of 2002 and the adoption of the theory of the company for the legislation homeland. In the sequence, he/she takes care of the sources of the Commercial Right and of the trade transition to the company in the nomenclature of that discipline. At the end, if approached the problem around the possible loss of autonomy of that branch of the right, in reason of the legislative unification of the Brazilian private right.
